Terms of Service

1. Who you are contracting with
These Terms of Service (“Terms”) are a legal agreement between you and Getting Market, trading as The Dutch Guests, established in Den Helder, the Netherlands, registered with the Dutch Chamber of Commerce (KVK) under number 96364335(“we”, “us”, “The Dutch Guests”). They govern your access to and use of the website thedutchguests.nl and the platform “The Dutch Guests Connect” (together, the “Platform”).
2. Acceptance
By creating an account or continuing to use the Platform you agree to these Terms. If you are accepting on behalf of a company, you confirm that you have authority to bind that company. The Platform is intended for business use; you must be at least 18 years old.
3. What the Platform is
The Dutch Guests Connect is an intelligence and introduction platform that helps accommodations and travel organisations discover each other and, on mutual approval, exchange contact details to start a commercial conversation. We do not act as an agent, broker, or booking engine, we do not negotiate on your behalf, and we are not a party to any commercial arrangement that you reach with a counterpart.
4. Your account and content
- You must provide accurate information and keep it up to date.
- You are responsible for keeping your login credentials confidential and for everything that happens under your account.
- You grant us a limited licence to host, display and process your company profile, campaigns, activations, and messages solely to operate the Platform and to make relevant matches and introductions.
- You must have the rights necessary to share whatever you upload or submit through the Platform.
5. Acceptable use
You must not:
- use the Platform to break the law, infringe intellectual property, or deceive other users (including creating fake profiles or misrepresenting your company);
- use match, introduction or contact information for anything other than a genuine business conversation with the introduced counterpart — no bulk outreach, no reselling of contacts, no scraping;
- send spam, harass other users, or send unsolicited marketing that breaches applicable law;
- probe, scan or interfere with the security of the Platform, upload malware, or attempt to circumvent access controls or rate limits;
- reverse engineer, decompile, resell, or sublicense the Platform.
6. Introductions and paid unlocks
Some features — in particular, unlocking counterpart contact details after a two-sided introduction is approved — require payment. When you trigger a paid unlock, contact details are revealed to you on the Platform. What happens after that reveal (whether the counterpart replies, whether you close a deal, and what commercial terms you agree) is between you and the counterpart. We do not guarantee any commercial outcome, level of interest, response, or timeline.
7. Payments, subscriptions and refunds
Our order process is conducted by our online reseller Paddle.com Market Ltd. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and renewal mechanics are governed by Paddle’s Checkout / Buyer Terms.

8. Intellectual property
We (and our licensors) own the Platform, its underlying software, the matching logic, our brand, and all associated intellectual property. We grant you a limited, non-exclusive, non-transferable right to use the Platform in accordance with these Terms and the plan you are on. Nothing in these Terms transfers ownership to you.
9. Service availability
We work hard to keep the Platform running, but we do not guarantee that it will be uninterrupted, timely, secure or error-free. We may perform maintenance, roll out changes, and adjust features from time to time.
10. Suspension and termination
We may suspend or terminate your access to the Platform if you materially breach these Terms, fail to pay, put the Platform or other users at risk (including security, fraud, or abusive behaviour), or repeatedly ignore our policies. You can stop using the Platform at any time; account closure requests can be sent to yannick@gettingmarket.nl. On termination, your right to use the Platform ends immediately; provisions that by their nature should survive (for example, IP, liability, governing law) will survive.
11. Warranties and liability
To the maximum extent permitted by Dutch law, the Platform is provided “as is” and we disclaim all implied warranties of merchantability, fitness for a particular purpose and non-infringement. Our aggregate liability arising out of or in connection with these Terms, whether in contract, tort or otherwise, is limited to the total fees you have paid to us for the Platform in the 12 months immediately preceding the event giving rise to the claim.
We will not be liable for indirect, incidental, special or consequential damages, including loss of profits, loss of business, loss of data, or loss of goodwill. Nothing in these Terms limits liability that cannot be excluded under Dutch law (for example, fraud, wilful misconduct, or death or personal injury caused by negligence).
12. Indemnity
You will defend and indemnify us against third-party claims arising from: (a) content or information you submit through the Platform; (b) your unlawful use of the Platform; or (c) your breach of these Terms.
13. Changes to these Terms
We may update these Terms from time to time. If a change is material, we will let you know via the Platform or by email. Continued use after a change takes effect means you accept the updated Terms.
14. Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control (for example, outages of upstream providers, network incidents, natural events, or government action).
15. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
16. Governing law and jurisdiction
These Terms are governed by Dutch law. Any dispute that cannot be resolved amicably will be brought exclusively before the competent courts in the Netherlands.
